Conflicts in Luxembourg municipalities are rare
The Luxembourg Minister of the Interior, Léon Gloden, in response to a parliamentary enquiry, emphasised the importance of maintaining good governance and a positive climate in municipal administrations. However, he noted that the Ministry does not have the power to intervene directly in conflicts between staff and municipal management.
According to the minister, recent media reports of tensions in individual municipalities are the exception, not the rule. Of the one hundred communes and seventy inter-municipal syndicates, only a few have experienced conflicts.
The minister noted that disciplinary action depends on the status of the employees.
- The law of 24 December 1985, identical to the civil service rules, applies to municipal employees.
- Employees hired under labour contracts are subject to the Labour Code or collective agreements, if any.
Although the Ministry of Interior is not authorised to act as a mediator in such situations, it provides access to psychological assistance through a special service of the Ministry of Public Service. However, there is no specialised "mediation cell" for such conflicts.
