The ECtHR has condemned Switzerland. What are the consequences for Luxembourg
The ECHR's judgement in the case against Switzerland was an important milestone in the interaction between climate and human rights. The Court recognised that inadequate climate policies can violate citizens' fundamental rights to life and health. This sets a dangerous precedent for other countries in Europe, including Luxembourg, where lawsuits on similar grounds may also arise.
The Ministry of Environment said that it had analysed in detail the ECHR verdict and Luxembourg's relevant commitments. Serge Wilmes emphasised that the authorities consider the current climate measures to be sufficient and in line with international standards. At the same time, the Minister noted that the country is ready to strengthen the measures if judicial precedents require adjustments in climate policy.
Serge Wilmes addressed the topic of human rights in the context of the fight against climate change, drawing attention to the fact that any policy must take into account both the protection of the environment and the civil liberties and security of the population. The Minister also referred to a previous parliamentary enquiry on the same issue, pointing out the continuity in the approach to climate issues.
