Cannabis has been the subject of intense debate in Luxembourg for a long time. But it is a so-called "recreational" drug. In other words, it is a drug that any citizen of the country can buy in a certain amount.

Nothing new under the sun

The first version of the bill was ready at the end of last year. It was due to be discussed in the June session, but was postponed at the last minute. The bill was sent back for revision and a new date was set for the summer of 2023.

Legalising marijuana was not a spontaneous idea. The experience of the Netherlands had long been observed in Luxembourg. Last summer there was also a meeting between Germany, the Grand Duchy, Malta and the Netherlands. The aim was to discuss drug policy and the recreational use of cannabis.

The participants agreed that repressive policies have negative consequences. Marijuana use has increased over the last 10 years, but so have drug trafficking, smuggling and other criminal activities unwanted by the states.

Medical cannabis has been prescribed in Luxembourg recently quite frequently. The main difference with recreational cannabis is that preparations are mostly uses oil and inflorescences. Recreational "weed" is mostly uses in the form of ground dried leaves. In addition, medical cannabis can only be bought in hospitals. It is only available with a doctor's prescription.

If the law passes

If the vote is successful — and the Government Council has already approved the initiative, by the way — the State will be required to set up a legal and controlled chain for producing and supplying cannabis. Citizens will have the right to have a maximum of four plants at home. It will also be possible to buy cannabis at specialised and certified points of sale.

But restrictions will remain. For example, you will not be able to smoke your purchase in a public place — there will be a fine if you do so. It will also be possible to carry no more than 3 grams of marijuana at a time, although possession will no longer be an offence.

Another important point is that the legalisation of marijuana will only have an effect on the citizens of the country. Neither tourists nor foreigners, even those with a long-term residence permit, will be able to afford to buy cannabis.
