How the operating conditions of companies in Luxembourg are updated: the ministry explains the mechanism

The Minister of Labour, Georges Mischo, presented details of the work to develop and update the "conditions-types" - standard conditions governing the requirements for the operational activities of classified enterprises in Luxembourg. The answer was given in response to a parliamentary enquiry by Marc Baum.

The conditions are developed by a specialised unit, ÉSA (Établissements soumis à autorisations), within the Inspectorate of Labour and Mines (ITM). This unit is made up of 26 technical experts and 7 administrative staff. They are responsible both for processing applications for authorisations and for drawing up standard conditions.

There are four key criteria that are considered in the development or update process:

  • Practical experience of ITM inspectors and users of the conditions in the field;
  • technological innovations and best available practices;
  • changes in the regulatory and legislative framework;
  • consultation with accredited laboratories, engineering offices and professional organisations.

All changes are discussed in working groups involving experts, representatives of business and professional structures.

ITM staff not only develop the conditions, but also advise employers and employees on their application. In 2024, the ÉSA unit held 493 external meetings and responded to numerous enquiries by email and telephone.

Moreover, anyone can send feedback via the ITM-SST 6002.1 form on the official itm.lu website - helping to shape a dynamic and adaptable environment.

ITM emphasises that it constantly takes into account responses from the field and the best technical solutions, and consults with the Order of Architects and Engineers (OAI), Civil Protection (CGDIS) and professional chambers before adopting finalised terms and conditions.
