In Luxembourg, only 52.1 per cent of the legal quota is employed

A joint report by the Minister of Labour Georges Michaud and the Minister of Public Service responds to a parliamentary enquiry on the implementation of employment quotas for people with disabilities in the public and private sectors. According to the law, the quota is 5 per cent of the total number of employees.

Public institutions

1,846 employees with disabilities (salariés handicapés, SH) should be employed, but only 962 are actually employed - 52.1 per cent of the norm.

Utilities

Of the required 718 employees with disabilities, only 294 (40.9 per cent) are working.

State-owned enterprises

Of the required 871 people, only 81 (9.3 per cent) are actually working.

Of all 102 communes, only 26 meet or exceed the standard.

Private sector

  • Companies with 25-49 employees employ 17.1 per cent of the eligible number of people with disabilities.
  • In firms with 50-299 employees, the figure is 23.6 per cent.
  • In large companies with more than 300 employees the quota was fulfilled only by 11.1 per cent.

Less than 1% of large companies comply with the law, highlighting the low level of inclusion in large enterprises.

One reason for not meeting quotas is the reluctance of some employees to declare their status for fear of stigmatisation. This makes monitoring more difficult and can lead to companies being unaware of actual quota achievement.

The authorities consider it important not to resort to sanctions, but to develop incentives and raise awareness among employers about available state support programmes. The Minister of Labour stressed that the key to increasing inclusion is to create an atmosphere of trust where people with disabilities are not afraid to talk openly about their status.

Furthermore, the creation of a common platform bringing together all stakeholders is already on the agenda of the meeting of the Standing Committee on Labour and Employment.

In the long term, the main goal is not only to meet quotas, but also equal opportunities for all candidates on the labour market, where competences become more important than limitations.
