Problems of stateless persons in Luxembourg: legal subtleties and implications

The response of Minister of Justice Elisabeth Margue and Minister of the Interior Léon Gloden to a parliamentary enquiry shed light on the complex situation of stateless persons (stateless persons) in Luxembourg. The questions centred on the legal consequences for people who refuse to cooperate with the authorities in establishing their identity.

The authorities confirmed that a stateless person's refusal to co-operate with the relevant authorities does not entail any legal penalty. However, this refusal has a significant impact on the daily lives of these people.

If a person's identity is not confirmed by official documents, the court accepts data obtained by the police. If false information is provided, the court also uses fictitious data. This creates additional risks and makes identification more difficult.

Persons released from the detention centre without established documents cannot obtain a certificate of registration at the place of residence, open a bank account or obtain a driving licence. The lack of legal status effectively excludes them from the legal and social system.

In order to receive state aid, a valid identity card must be presented. If a person does not meet this requirement, the only option is to apply to non-governmental organisations and charitable foundations.
