Luxembourg is on the warpath against discrimination

Luxembourg's Justice Minister Elisabeth Marg submitted a response to a parliamentary enquiry, clarifying measures to combat discrimination and incitement to hatred in the country.

Key provisions of the legislation

Article 454 of the Criminal Code

Discrimination is defined as any distinction made on the basis of origin, political or philosophical views, membership or non-membership of an ethnic group, nation, race or religion. This applies to both individuals and legal organisations.

Penalties for discrimination

Prison sentences of 8 days to 2 years and/or a fine of €251 to €25,000.

Incitement to hatred (art. 457-1)

Includes public statements, threats or dissemination of material that promotes hatred.

The Act of 28 March 2023 introduced a new aggravating circumstance: if the offence is committed on the basis of discriminatory motives, the maximum sanctions for the offence may be doubled within the limits allowed by law.

In cases of personal threats, citizens can file a police report to protect their rights.
